What a Virginia Notary Can Notarize
- General documents. Paternity papers, divorce and separation agreements, financial documents, school forms.
- Legal documents. Wills, powers of attorney, affidavits.
- Acknowledgments. Signer confirms identity and willingness (e.g., deeds, mortgages).
- Oaths and affirmations. Signer swears/affirms contents are true.
- Certified copies. True copies of documents not in custody of a court or vital records office.
- Verification of fact. Validating identity or facts via public records.
- Safe deposit boxes. Witnessing opening of safe deposit boxes.
What a Virginia Notary Cannot Notarize
- Documents in the custody of a court.
- Vital records (birth, death, marriage certificates).
- Anything requiring legal advice or opinions.
- Documents where the notary has a personal interest (including own signature).
- Incomplete documents or those with missing/incorrect notarial wording.
Other Important Rules
- Physical presence. The signer must be present unless permitted otherwise by law.
- Refusal. A notary may refuse to notarize for any reason.
